Title 13 EDUCATION

Chapter 13.1 Education

Part 13.1.1 Department of Education Enabling Act

13.1.1.010 Findings

(a) annual budget items may only be included if they have first been authorized by law as required by Section 5(a)(ii)(A) of the Agreement;

(b) The Council finds that reorganizing the structure of governmental departments and programs will promote efficiency within the Tribe;

(c) The Council finds that establishing the Department of Education will assist the Tribe in providing direction and management of the Pueblo's educational initiatives.

13.1.1.020 Short Title

This enactment shall be known as the Department of Education Enabling Act ("Act").

13.1.1.030 Definitions

(a) "Agreement" means the Pueblo de San Ildefonso governing Agreement.

(b) "Council" means the Pueblo de San Ildefonso Council.

(c) "Governor" means the Pueblo de San Ildefonso Governor.

(d) "Pueblo" means the Pueblo de San Ildefonso.

13.1.1.040 Purpose

The Purpose of the Act is to establish the Department of Education.

13.1.1.050 Findings

The Council hereby finds and declares that:

(a) reorganizing the structure of governmental departments and programs will promote efficiency within the Tribe; and

(b) establishing a Department of Education will assist the Tribe in achieving its educational endeavors.

13.1.1.060 General Policy

Department of Education. This act shall establish the Department of Education to carry out the Pueblo's educational initiatives.

13.1.1.070 Organization of the Department of Education

(a) There shall be a Director of the Department of Education who shall oversee the general supervision of the department.

(b) In order to promote efficiency within the Department of Education, program offices will be established as necessary. A program director shall oversee the general supervision of the each program office and shall report to the Director of the Department of Education.

(c) The Department of Education includes the following program offices:

(1) Early Childhood

(2) Farm

(3) Scholarship

(4) After School & Summer Program

(5) Po-who-ge-oweenge (Tewa Language) Program

13.1.1.080 Department of Education Goals and Objectives

The overall goals of the Department of Education ("Department") are to promote student achievement and educational excellence. The Department shall improve the quality and effectiveness of education andpromote interest in higher education.

13.1.1.090 Amendment

The Council may amend this enabling act or reorganize the Department of Education at any time upon majority vote of the Council.

13.1.1.100 Sovereign Immunity

Nothing in this Act waives the sovereign immunity of the Pueblo or any of its representatives, officers, or employees.

13.1.1.110 Severability

If a court of competent jurisdiction finds any provision of this Act to be invalid or illegal under applicable tribal and/or federal law, such provision shall be severed from this Act and the remainder of this Act shall remain in full force and effect.

Part 13.1.2 San Ildefonso Pueblo Scholarship Endowment Fund

13.1.2.010 Findings

(a) The Pueblo recognizes that the Pueblo does have a Scholarship Endowment Fund for scholarships;

(b) The Pueblo recognizes that the Pueblo de San Ildefonso Scholarship Endowment Fund must have an established principal amount; which cannot be used for scholarships, as only the interest earned on the principle amount can be used for scholarships.

13.1.2.020

The total of $1,000,000.00 be recognized on the books of the Pueblo de San Ildefonso as the principal amount of the Pueblo de San Ildefonso Scholarship Endowment Fund, and that any interest earned on the principal amount may be used exclusively for scholarships.

13.1.2.030

The total of $1,025,000.00 be invested in United States Treasury Bill, with Los Alamos National Bank for a period of one (1) year. After one (1) years time an analysis will be done to determine what amount will be needed for scholarships for FY 2013. The Scholarship Endowment Fund amount will be established at that time.

Part 13.1.3 Supplemental Indian Education Program Modernization Act of 2017 (S. 943)

13.1.3.010 Short Title

This enactment shall be known as the "SUPPLEMENTAL INDIAN EDUCATION PROGRAM MODERNIZATION ACT OF 2017 (S. 943) ("Act")."

13.1.3.020 Purpose

The purpose of this Act is to support efforts to update and modernize the Johnson O'Malley (JOM) program and establish true funding level determinations.

13.1.3.030 Findings

The Council hereby finds and declares that:

(a) The Pueblo de San Ildefonso ("Pueblo") is a federally recognized Indian tribe eligible for the services provided to Indians by the Secretary of the Interior because of the Pueblo's status; and,

(b) The Pueblo advocates for students, ages 3 through high school, who are enrolled in, or eligible for enrollment in, a federally-recognized tribe and not attending or served by Bureau of Indian Education (BIE) schools, and who are currently being served from respective tribal jurisdiction boundaries and service areas; and,

(c) The JOM funding and the certified student count of 278,000 has been at its 1995 level even though, according to data collected by the U.S. Census Bureau in 2010, there are 798,486 American Indian and Alaska Native students in the age group eligible to receive JOM assistance, effectively leaving many students with unmet needs; and,

(d) JOM programs that foster specialized, culturally sensitive, and unique educational programs that develop leadership skills of future tribal leaders necessary to promote positive academic, social, and economic changes in Indian communities will cease to exist without continued and appropriate levels of annual funding from Congress.

13.1.3.040 Support for JOM Program

(a) The Pueblo supports efforts to update and modernize the JOM program including advocating for true funding level determinations.

(b) The Pueblo hereby approves this Act in support of the enactment of S. 943, which supports the Pueblo's prevailing social and cultural standards, and protects the best interests of the community.

Chapter 13.2 Language Project

Part 13.2.1 Support Resolution For Pueblo de San Ildefonso Tewa Language Project

13.2.1.010 Findings

(a) Since time immemorial the Pueblo de San Ildefonso has spoken the Tewa language;

(b) It is of grave concern to our People members that the Tewa language is not being reinforced as a primary language in our community; and it has always been the language through which the history, culture and governance have been passed on at the Pueblo de San Ildefonso;

(c) In order for the Tewa language to survive as a primary language, Tewa language instruction must be implemented within all the learning environments of the Pueblo including the homes of the Pueblo de San Ildefonso.

13.2.1.020

Be it resolved that the Native Language Preservation and Maintenance application be submitted and if funding is awarded, project activities be implemented to accomplish the goals and objectives during the thirty-six month project period.

13.2.1.030

Be it further resolved that the Tewa Language Committee be authorized, in conjunction with the Pueblo Department of Education, and community to develop a Tewa Language Revitalization Model, and develop and present draft Resolution on language issues to the Tribal Council for approval.
