25.1.1.100 Absence of Commission

In the event that the Commission is not Organized or has not been appointed, the Tribal Judiciary will function as the Commission, and in the absence of both, the Governor will function as the Commission, For purposes of section 40.1 only, in the event of the absence of the commission and the Judge, the Governor will function as the Commission or in the absence of the commission and the Judge, the Governor will function as the commission.
