25.1.3.100 Refusal to Issue License—-Cancellation or Suspension of License of Use of Temporary Permits –Hearings

The San Ildefonso Tribal Court may suspend a license or use of temporary permits for violation of the provisions of this Code. The Court shall take the action herein authorized only after hearing. Notice of such hearing shall be given the party concerned as provided. Such notice shall state the proposed action of the Court and the reason for such proposed action.

(a) The Court shall prepare rules and regulations for the conduct of such hearing. At such hearing the technical rules of evidence shall not apply, a party shall have the right to be represented by counsel, to call witnesses in his own behalf; and to cross-examine the witnesses of other parties.

(b) The Judge shall conduct the hearing for the Court and shall cause a record of hearing to be made.

(c) Within ten (10) days after completion of the hearing, the Judge shall cause to be served upon all parties, in the manner provided in this Code, his findings and decision. The decision shall be either:

(1) Suspension of a license for a time stated and notice to the State Department of Motor Vehicles.

(2) Continuing use of a permit, cancellation of use of tem-porary permits or suspension of use of temporary permits for a time stated, and notice to the State Department of Motor Vehicles.
