25.1.9.110 Persons Under Influence of Intoxicating Liquor or Drugs

(a) It is unlawful for any person who is under the influence of intoxicating liquor to drive or to be in actual physical control of any vehicle within the jurisdiction of the San Ildefonso Pueblo.

(b) It is unlawful for any person who is a habitual user of, or under the influence of, any narcotic drug, or who is under the influence of any drug to a degree which renders him incapable of safely driving vehicle, to drive or to be in actual physical control of any vehicle within the jurisdiction of the San Ildefonso Pueblo. The fact that any person charged with a violation of this subsection is or has been entitled to use such drug under the laws of this state is not a defense against the charge;

(c) For every violation of this section, the violator shall Pay a Penalty assessment, After the first violation, the Tribal Court may revoke or suspend the violators license.
