Resolution No. SI-R21-003: Amendment to Council Resolution No. SI-R20-003, Act Authorizing Assessment of Areas for Potential Warehouse and Distribution Center
At a duly called meeting of the Council of San Ildefonso Pueblo on the 29th day of April , 2021, the following law was adopted:
WHEREAS, the Pueblo de San Ildefonso ("Pueblo") is a sovereign and self-governing Tribe, recognized as such by the United States of America; and,
WHEREAS, the voters of the Pueblo approved a Governing Agreement ("Agreement") for the Pueblo on November 19, 2011, and the Bureau of Indian Affairs approved the Agreement on December 21, 2011 pursuant to Federal law; and,
WHEREAS, the Pueblo Council ("Council") is the duly constituted Legislative body acting for the Pueblo; and,
WHEREAS, the Council is authorized to make laws for the Pueblo pursuant to Section 5 of the Agreement; and,
WHEREAS, in Council Resolution No. SI-R20-003 dated March 12, 2020, the Pueblo authorized the assessment of three parcels for potential warehouse and distribution centers for Los Alamos National Laboratory (LANL) operations on Pueblo land which included White Rock, Totavi Station, and a site in the vicinity of State Road 502 and CMR 101D; and,
WHEREAS, the Pueblo approved the Land Use Plan for the Pueblo's Master Plan Development on May 23, 2017 ("Land Use Plan") approving and identifying two parcels of land designated for commercial and industrial use ("Scheme 3") a map of which is attached hereto as Attachment A; and,
WHEREAS, the SIS Member's Representatives discussed and recommended that Scheme 3 be added to the three parcels already identified and authorized in Council Resolution No. SI-R20-003 specifically for the assessment of a warehouse and distribution center on Pueblo lands; and,
WHEREAS, the SIS Member's Representatives further recommended the use of these parcels of land be expanded to include an RV Park and Apartments, each of which was previously presented to the Pueblo by officials or representatives from LANL, in further support of economic development of the Pueblo; and,
WHEREAS, the SIS Member's Representatives recognize further that additional economic development opportunities have been considered and should also be added to the list of potential activities being considered for the same parcels of land including Renewable Energy projects; and,
WHEREAS, the Council has determined it is in the Pueblo's best interest to amend SI-R20-003 to incorporate the two parcels identified in Scheme 3 of the Land Use Plan.
NOW THEREFORE BE IT RESOLVED, that the Council hereby amends Resolution No. SI-R20-003 entitled "ACT AUTHORIZING ASSESSMENET OF AREAS FOR POTENTIAL WAREHOUSE AND DISTRIBUTION CENTER" to include the parcels identified in Scheme 3 of the Land Use Plan and to expand the uses of these parcels to include an RV Park, Apartments, and Renewable Energy projects. All other provisions contained in Council Resolution No. SI-R20-003 shall remain the same.
AMENDMENT TO COUNCIL RESOLUTION NO. SI-R20-003, ACT AUTHORIZING ASSESSMENT OF AREAS FOR POTENTIAL WAREHOUSE AND DISTRIBUTION CENTER
Section 1.1. Short Title
This enactment shall be known as the "AMENDMENT TO COUNCIL RESOLUTION NO. SI-R20-003, ACT AUTHORIZING ASSESSMENT OF AREAS FOR POTENTIAL WAREHOUSE AND DSITRIBUTION CENTER."
Section 1.2. Purpose
The purpose of this amendment is incorporate two additional parcels of land identified in "Scheme 3" of the Land Use Plan for the assessment of a warehouse and distribution center on Pueblo lands.
Section 1.3. Findings
The Council hereby finds and declares that:
(a) In Council Resolution No. SI-R20-003 dated March 12, 2020, the Pueblo authorized the assessment of three parcels for potential warehouse and distribution centers for Los Alamos National Laboratory (LANL) operations on Pueblo land which included White Rock, Totavi Station, and a site in the vicinity of State Road 502 and CMR 101D; and
(b) The Pueblo approved the Land Use Plan for the Pueblo's Master Plan Development on May 23, 2017 ("Land Use Plan") approving and identifying two parcels of land designated for commercial and industrial use ("Scheme 3") a map of which is attached hereto as Attachment A; and
(c) The SIS Member's Representatives discussed and recommended that Scheme 3 be added to the three parcels already identified and authorized in Council Resolution No. SI-R20-003 for the assessment of a warehouse and distribution center on Pueblo lands; and
(d) The SIS Member's Representatives further recommended the use of these parcels of land be expanded to include an RV Park and Apartments, each of which was previously presented to the Pueblo by officials or representatives from LANL, in further support of economic development of the Pueblo; and
(e) The SIS Member's Representatives recognize further that additional economic development opportunities have been considered and should also be added to the list of potential activities being considered for the same parcels of land including Renewable Energy projects; and
(f) The Council has determined it is in the Pueblo's best interest to amend SI-R20-003 to incorporate the two parcels identified in Scheme 3 of the Land Use Plan.
Section 1.4. Amendment
Title 17, Chapter 3.1, Section 3.1.030 of the Code is hereby amended to include two additional parcels of land as identified in Scheme 3 of the Land Use Plan.

The foregoing resolution was duly voted upon by the Council on April 29 , 2021, at a meeting with a vote of 10 in favor, 0 opposed, 0 abstaining and 0 absent (Governor presiding and not voting) pursuant to the authority vested in the Council by the Agreement of the Pueblo de San Ildefonso.
