Resolution No. SI-R21-006: Senior Center Act and the Evaluation of Services and Funding Administered by the Eight Northern Indian Pueblos Council, Inc.
At a duly called meeting of the Council of San Ildefonso Pueblo on the 29th day of April , 2021, the following law was adopted:
WHEREAS, the Pueblo currently contracts with the Eight Northern Indian Pueblos Council, Inc. ("ENIPC") to operate the Senior Center at the Pueblo and to provide services to seniors; and,
WHEREAS, ENIPC receives certain federal and state funds on behalf of the Pueblo to pay for the operation and management of the Senior Center at the Pueblo, including hiring and directing the Site Manager for the Senior Center; and,
WHEREAS, The Governor and Council Representatives have received requests from members of the Pueblo to evaluate the quality and delivery of services to the Senior Center provided by ENIPC including the improvement of services and whether the Pueblo should continue to contract with ENIPC to operate the Senior Center; and,
WHEREAS, the Council desires to study and evaluate the current funding and management of the Senior Center prior to any decision to modify the current arrangement with ENIPC.
NOW THEREFORE BE IT RESOLVED, that the Council hereby enacts the attached law entitled
"SENIOR CENTER ACT AND THE EVALUATION OF SERVICES AND FUNDING
ADMINISTERED BY THE EIGHT NORTHERN INDIAN PUEBLOS COUNCIL, INC".
SENIOR CENTER ACT AND THE EVALUATION OF SERVICES AND FUNDING ADMINISTERED BY THE EIGHT NORTHERN INDIAN PUEBLOS COUNCIL, INC.
Section 1.1. Short Title
This enactment shall be known as the "SENIOR CENTER ACT".
Section 1.2. Purpose
The purpose of this act is to authorize and direct the completion of a comprehensive study, evaluation, and analysis of the current funding and management of the Senior Center ("Senior Center") including options for improving the delivery of services.
Section 1.3. Findings
The Council hereby finds and declares that:
(a) The Pueblo currently contract with the Eight Northern Indian Pueblos Council, Inc. ("ENIPC") to operate the Senior Center and to provide services to seniors; and
(b) ENIPC receives certain federal and state funds on behalf of the Pueblo to pay for the operation and management of the Senior Center, including hiring and directing the Site Manager for the Senior Center; and
(c) The Governor and Council Representatives have received requests from members of the Pueblo to evaluate the quality and delivery of services at the Senior Center provided by ENIPC, including the improvement of services and whether the Pueblo should continue to contract with ENIPC to operate the Senior Center; and
(d) The Council desires to study and evaluate the current funding and management of the Senior Center prior to any decision to modify the current arrangement with ENIPC.
Section 1.4. Senior Center Report of 2021
(a) The Council hereby authorizes and directs the Governor and the Director of Health and Human Services, Elderly Services Committee, or a designee, to conduct a written, comprehensive review, evaluation, and analysis of the current programs and services provided at the Senior Center by the ENIPC and related issues ("Senior Center Report of 2021").
(b) The Senior Center Report shall include the following:
i. An evaluation of the operation of the Senior Center by ENIPC including the current programs and services;
ii. An evaluation of the management and staffing of the Senior Center by ENIPC including the selection and supervision of the Site Manager by ENIPC;
iii. The types and amounts of funding received by ENIPC on behalf of the Pueblo to operate Senior Center;
iv. The administrative fees charged by ENIPC to operate the Senior Center;
v. The process to modify or cancel the current arrangement with ENIPC as the contractor that operated the Senior Center including whether incremental steps could be taken to move towards a Senior Center that is operated, managed, and administered by the Pueblo;
vi. An evaluation of the funding requirements to operate the Senior Center and the funding necessary to provide improved and/or expanded services;
vii. Any other observations and recommendations to assist the Council in evaluating delivery of services by ENIPC at the Senior Center including methods to improve the delivery, type, and scope of services.
(c) The Senior Center Report of 2021 shall be completed and delivered to the Council within sixty (60) days of the effective date of the Senior Center Act.
CERTIFICATION
The foregoing resolution was duly voted upon by the Council on April 29 , 2021, at a meeting with a vote of 10 in favor, 0 opposed, 0 abstaining and 0 absent (Governor presiding and not voting) pursuant to the authority vested in the Council by the Agreement of the Pueblo de San Ildefonso.

Resolution No. SI-R21-006 was presented to the Governor of the Pueblo de San Ildefonso on the 30th day of April , 2021, pursuant to the Governing document of the Pueblo de San Ildefonso ("Agreement"), GOVERNOR, Sec. 4(c), and will become effective after signature by the Governor or veto override by the Council.
