Resolution No. SI-R21-015: American Rescue Plan Funding Authorization Act

At a duly called meeting of the Council of San Ildefonso Pueblo on the 29th day of June, 2021, the following law was adopted:

WHEREAS, the Pueblo de San Ildefonso ("Pueblo') is a sovereign and self-governing Tribe, recognized as such by the United States of America; and,

WHEREAS, the Council is authorized to make laws for the Pueblo de San Ildefonso pursuant to Section 5 of the Governing Agreement, the governing document of the Pueblo; and,

WHEREAS, Congress passed the American Rescue Plan Act of 2021 which authorized funds to our Pueblo (and others) in the form of an addition to our Aid To Tribal Government Program (ATTG) and a new contract for Housing (BIA housing – HIP); and,

WHEREAS, to contract these funds the Tribe is required to submit a Tribal Resolution authorizing such contracts and the Council wishes to do so.

NOW THEREFORE BE IT RESOLVED, that the Council hereby approves and adopts this resolution in accordance with the requirements of our Governing Agreement, according to published Council procedures, and authorizes and directs the Governor, or his designee, to take such actions as deemed necessary to carry out the intent of this resolution which is to contract for these funds. The Governor is authorized to submit any additional documents, including statements and certification for and in behalf of the Pueblo to make this happen.

AMERICAN RESCUE PLAN FUNDING AUTHORIZATION ACT

Section 1.1. Short Title

This enactment shall be known as the "AMERICAN RESCUE PLAN FUNDING AUTHORIZATION ACT."

Section 1.2. Purpose

The purpose of this Act is authorize the Governor to submit funding requests to the Bureau of Indian Affairs to receive such funds as authorized from the American Rescue Plan 2021.

Section 1.3. Findings

The Council hereby finds and declares that:

(a) Congress passed the American Rescue Plan Act of 2021 which authorizes funds to our Pueblo (and others); and

(b) These funds will be in the form of an addition to our Aid To Tribal Government Program (ATTG) and a new contract for Housing (BIA housing – HIP); and

(c) The ARP plan requires a resolution from the Pueblo to access these funds.

Section 1.4. Authorizations

(a) The Council hereby authorizes the Governor to submit a request for any ARP funds and contract the same.

(b) The Governor is authorized to submit any additional documents, including statements and certification for and on behalf of the Pueblo to make this happen.

CERTIFICATION

The foregoing resolution was duly voted upon by the Council on June 29 , 2021, at a meeting with a vote of 9 in favor, 0 opposed, 0 abstaining and 1 absent (Governor presiding and not voting) pursuant to the authority vested in the Council by the Agreement of the Pueblo de San Ildefonso.
