Resolution No. SI-R25-005: Act Amending Election Law Absentee Voting Provisions
At a duly called meeting of the Council of San Ildefonso Pueblo on the 26th day of June, 2025, the following law was adopted:
WHEREAS, the Pueblo de San Ildefonso ("Pueblo") is a sovereign and self-governing Tribe, recognized as such by the United States of America; and
WHEREAS, the sovereign authority of the Pueblo is vested in its Council and Governor; and
WHEREAS, the Pueblo's Election Law governs the scope and process for tribal elections; and
WHEREAS, the Election Law was amended in 2023 to allow absentee voting by students and active military personnel who will be out of state at the time of a tribal election, and for homebound tribal elders who are not be able to physically appear at the tribal polling place; and
WHEREAS, the Election Commission has proposed changes to the Election Law absentee voting provisions to allow for absentee voting by tribal member spouses of active military personnel who will be out of state at the time of a tribal election, as well as clarifying that absentee voting for homebound elders is for those elders who reside within the Pueblo's boundaries, as shown on Attachment A hereto; and
WHEREAS, the Council has reviewed the proposed changes to the Election Law and determines it is in the best interest of the Pueblo to authorize amendment of the Election Law absentee voting provisions regarding spouses of active military personnel and homebound elders.
NOW THEREFORE BE IT RESOLVED THAT the Council hereby enacts the attached law entitled the "ACT AMENDING ELECTION LAW ABSENTEE VOTING PROVISIONS."

ACT AMENDING ELECTION LAW ABSENTEE VOTING PROVISIONS
Section 1.1. Short Title
This enactment shall be known as "Act Amending Election Law Absentee Voting Provisions" ("Act").
Section 1.2. Purpose
The purpose of this Act is to authorize the amendment of the Pueblo's Election Law absentee voting provisions in tribal elections to include spouses of active duty military members and to clarify the eligibility for homebound elders.
Section 1.3. Findings
The Council hereby finds and declares that:
(a) The Pueblo's Election Law governs the scope and process for tribal elections.
(b) The Election Law was amended in 2023 to allow absentee voting by students and active military personnel who will be out of state at the time of a tribal election, and for homebound tribal elders who are not be able to physically appear at the tribal polling place.
(c) The Election Commission has proposed changes to the Election Law absentee voting provisions to allow for absentee voting by tribal member spouses of active military personnel who will be out of state at the time of a tribal election, as well as clarifying that absentee voting for homebound elders is for those elders who reside within the Pueblo's boundaries.
(d) The Council has reviewed the proposed changes to the Election Law and determines it is in the best interest of the Pueblo to authorize amendment of the Election Law absentee voting provisions regarding spouses of active military personnel and homebound elders.
Section 1.4. Council Authorizations
(a) The Election Law absentee voting provisions shall be amended to allow absentee voting in tribal elections in the limited situations as shown in Attachment A hereto.
(b) The Election Commission is authorized to take such actions as deemed necessary to carry out the intent of this Resolution.
