Resolution No. SI-R25-006: Act Authorizing a Service Line Agreement with Los Alamos County

At a duly called meeting of the Council of San Ildefonso Pueblo on the 26th day of June, 2025, the following Resolution was adopted:

WHEREAS, the Pueblo de San Ildefonso ("Pueblo") is a sovereign and self-governing Tribe, recognized as such by the United States of America; and

WHEREAS, the sovereign authority of the Pueblo is vested in its Council and Governor; and

WHEREAS, Los Alamos County ("County") owns and operates an electric generation, transmission and distribution system within the County; and

WHEREAS, the Totavi Convenience Store ("Totavi Store") which is operated by San Ildefonso Services ("SIS") receives its electricity from the County over various electric lines, poles and other infrastructure owned by the Pueblo located on the Pueblo lands; and

WHEREAS, the County owns and operates its own electric utility system and has the personnel and equipment available to maintain the Pueblo's electric lines, poles and infrastructure serving the Totavi Store and surrounding area on Pueblo lands; and

WHEREAS, the Pueblo and the County wish to enter into an agreement for the County to provide agreed upon maintenance and repair services for the Pueblo-owned electric line and facilities that extend from the County's facilities onto Pueblo lands; and

WHEREAS, the Council has reviewed a form of a service line agreement with the County that is attached hereto as Exhibit 1 and determines it is in the best interest of the Pueblo to authorize the Governor to negotiate and sign a service line agreement with the County for the electric line and facilities that serve the Totavi Store and surrounding area.

NOW THEREFORE BE IT RESOLVED THAT the Council hereby enacts the attached law entitled the "ACT AUTHORIZING A SERVICE LINE AGREEMENT WITH LOS ALAMOS COUNTY."

CERTIFICATION

The foregoing resolution was duly voted upon by the Council on June 26, 2025, at a meeting with a vote of 6 in favor, 0 opposed, 3 abstaining and 1 absent (Governor presiding and not voting) pursuant to the authority vested in the Council by the Agreement of the Pueblo de San Ildefonso.

ACT AUTHORIZING A SERVICE LINE AGREEMENT WITH LOS ALAMOS COUNTY

Section 1.1. Short Title

This enactment shall be known as "Act Authorizing a Service Line Agreement with Los Alamos County" ("Act").

Section 1.2. Purpose

The purpose of this Act is to authorize the Governor to negotiate and sign a service line agreement with Los Alamos County ("County") to provide maintenance and repair services on the electric line and facilities owned by the Pueblo that serve the Totavi Store and the surrounding area.

Section 1.3. Findings

The Council hereby finds and declares that:

(a) The County owns and operates an electric generation, transmission and distribution system within the County.

(b) The Totavi Convenience Store ("Totavi Store") which is operated by San Ildefonso Services ("SIS") receives its electricity from the County over various electric lines, poles and other infrastructure owned by the Pueblo located on the Pueblo lands.

(e) The Council has reviewed a form of a service line agreement with the County that is attached hereto as Exhibit 1 and determines it is in the best interest of the Pueblo to authorize the Governor to negotiate and sign a service line agreement with the County for the electric line and facilities that serve the Totavi Store and surrounding area.

Section 1.4. Council Authorizations

(a) The Governor is authorized to negotiate and sign a form of a service line agreement similar to Exhibit 1 attached hereto.

(b) The Governor is authorized to take such actions as deemed necessary to carry out the intent of this Act.
