Resolution No. SI-R17-023: The Council Contracting Authorization Act of 2017

At a duly called meeting of the Council of San Ildefonso Pueblo on the 1st day of September, 2017, the following Resolution was adopted:

WHEREAS, the Pueblo de San Ildefonso ("Pueblo') is a sovereign and self-governing Tribe, recognized as such by the United States of America; and

WHEREAS, the Council is authorized to make laws for the Pueblo de San Ildefonso pursuant to Section 5 of the Agreement, the governing document of the Pueblo; and

WHEREAS, the Council has identified the need for professional advisors and consultants to assist the Council and Council Committees with their duties to write laws and prepare budgets; and,

WHEREAS, the Council finds it in the best interest of the Pueblo to authorize the Lt. Governor, on behalf of the Council, to enter into contracts, as specifically authorized by the Council, with professional advisors, consultants, and others necessary to fulfill the Council's duties to write laws and prepare budgets for the benefit of the People, subject to the appropriation of funds for such purposes.

NOW THEREFORE BE IT RESOLVED, that the Council hereby enacts the attached law entitled, "THE COUNCIL CONTRACTING AUTHORIZATION ACT OF 2017."

The foregoing resolution was duly voted upon by the Council on September 1, 2017, at a meeting with a vote of 8 in favor, 0 opposed, 0 abstaining and 2 absent (Governor presiding and not voting) pursuant to the authority vested in the Council by the Agreement of the Pueblo de San Ildefonso.

THE COUNCIL CONTRACTING AUTHORIZATION ACT OF 2017

Section 1.1. Short Title

This enactment shall be known as "THE COUNCIL CONTRACTING AUTHORIZATION ACT OF 2017 ("Act")."

Section 1.2. Purpose

The purpose of this Act is to authorize the Lieutenant Governor, on behalf of the Council, to enter into contracts, as specifically authorized by the Council, with professional advisors, consultants, and others necessary to fulfill the Council's duties to write laws and prepare budgets for the benefit of the People of the Pueblo, subject to the appropriation of funds for such purposes.

Section 1.3. Findings

The Council hereby finds and declares that:

(a) The Council has identified the need for professional advisors, consultants, and others to assist the Council with its duties to write laws and prepare budgets; and,

(b) The Governing Agreement requires that prior to the expenditure of funds on behalf of the Pueblo, the Council must authorize and appropriate funds in an approved budget for such purposes; and,

(c) The Council has identified the need to clarify the authorization and approval process for all services contracts entered into on behalf of the Council.

Section 1.4. Contracting Authorization

(a) The Council hereby authorizes the Lt. Governor, on behalf of the Council, to enter into contracts, as specifically authorized by the Council by Legislative Order, with professional advisors, consultants, and others necessary to fulfill the Council's duties to write laws and prepare budgets for the benefit of the People of the Pueblo.

(b) The services provided under any services contract entered into by the Council shall be limited to the exclusive benefit and use of the Council and/or Council Committee.

(c) Any contract entered into on behalf of the Council shall include a provision that such contract may be canceled at any time and for any reason by the Council.
